This Copyright Policy explains how intellectual property rights apply to content on Visiojoy, including content you create using our tools, content you submit as inputs, and content shared by others on the platform.

1. Ownership of AI-Generated Content

When you use Visiojoy to generate images or videos, you direct the creative process through your prompts, reference images, and settings. Subject to your compliance with our Terms of Service:

- Paid subscribers receive a license to use their generated content for personal and commercial purposes.
- Free-tier users receive a license for personal, non-commercial use only.

Important: The copyright status of purely AI-generated content is an evolving area of law. In the United States and many other jurisdictions, copyright protection generally requires human authorship. Visiojoy makes no representation that AI-generated outputs are automatically eligible for copyright protection. You are solely responsible for understanding the copyright laws applicable in your jurisdiction.

Visiojoy does not claim ownership over content you generate using our platform.

2. Your Inputs: Prompts and Reference Images

You retain any rights you already hold in the prompts and reference images you submit to Visiojoy. By submitting inputs, you represent and warrant that:

- You own or have the necessary rights and permissions to use those inputs.
- Your inputs do not infringe the intellectual property rights of any third party.
- Your inputs do not contain unlawful content.

You are solely responsible for ensuring your inputs comply with applicable copyright law. Visiojoy is not liable for any infringement arising from inputs you provide.

3. Content Sharing Settings

Visiojoy's workspace provides two content visibility controls that affect what rights you grant to others:

3.1 Public Visibility
When your generation is set to Public (the default):
- Your generated image or video is visible to other users and visitors on the platform.
- You grant Visiojoy a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content for platform operation and promotional purposes.
- You may set a generation to Private at any time. However, content that was previously public may have already been viewed, cached, or featured, and removal from all systems may not be immediate.

3.2 Copy Protection
When Copy Protection is disabled (the default):
- Other users may view your prompt text and any reference images associated with that generation.
- This allows others to learn from or build upon your creative approach.

When Copy Protection is enabled:
- Your prompt and reference images are hidden from other users.
- Only the generated output remains visible (subject to your Public/Private setting).

Enabling Copy Protection does not affect Visiojoy's internal use of your content as described in Section 4.

4. Visiojoy's Use of Your Content

By using Visiojoy, you grant us a non-exclusive, royalty-free, worldwide license to use your generated content and inputs for the following purposes:

- Operating, maintaining, and improving the platform
- Promotional and marketing materials

Visiojoy currently processes all AI generation through third-party API providers and does not use your content to train its own AI models. If this changes in the future, we will notify users in advance and provide a meaningful opportunity to opt out before any such use begins.

If you do not wish your content to be used for promotional purposes, you may opt out at any time by contacting us at support@visiojoy.com.

5. Third-Party Copyright and Prohibited Inputs

You may not use Visiojoy to:

- Reproduce, distribute, or create derivative works from third-party copyrighted material without authorization
- Generate content that incorporates protected characters, logos, or trademarks in a manner likely to cause infringement
- Upload reference images you do not have the right to use

Visiojoy respects the intellectual property rights of others and expects users to do the same.

6. DMCA Copyright Infringement Notification

Visiojoy complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on our platform infringes your copyright, please submit a written notice to our designated agent containing all of the following:

1. Your physical or electronic signature (or that of a person authorized to act on behalf of the copyright owner)
2. Identification of the copyrighted work you claim has been infringed
3. Identification of the material on our platform that you claim is infringing, with sufficient detail for us to locate it (e.g., URL)
4. Your contact information: name, address, telephone number, and email address
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on their behalf

We will respond to valid notices promptly. Submitting a false or bad-faith DMCA notice may expose you to legal liability.

7. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification to support@visiojoy.com containing:

1. Your physical or electronic signature
2. Identification of the content that was removed and its former location on the platform
3. A statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification
4. Your name, address, and telephone number
5. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the US, any judicial district in which Visiojoy may be found), and that you will accept service of process from the person who submitted the original notice

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If no legal action is filed within 10-14 business days, we may, at our discretion, restore the removed content.

8. Repeat Infringer Policy

Visiojoy will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. We reserve the right to make this determination at our sole discretion.
